Nue s.r.l. informs you that all the data you provide when accessing the Website and login your Account on the Marketplace Platform, as well as those provided during any interaction with software and/or other Users (in particular the Sellers) will be processed in accordance with the following provisions.

The Personal Data Controller is Nue s.r.l. with registered office in Milan, Via Ippolito Rossellini 12, no. REA MI-2592835, Tax Code 11292550966 at the Chamber of Commerce of Milan, Monza, Brianza, Lodi.

Nue s.r.l. process your information for the purposes described in this policy:

(a) for registration on the Site and/or for access it, by creating a personal account to the Transnational Marketplace Platform named Teascanner, for all the purchase and sale of Goods and Services on the Platform and for any other related activity, including, by way of example: the selection of goods or services, the promotion and marketing of goods or services for sale, the publication of descriptive and informative contents about goods or services offered for sale, the sending of orders and/or the relative acceptance, the shipment, delivery and/or any exercise of the right of withdrawal, the publication of ratings and reviews, the publication of comments and, in general, any activity related to the efficient and effective use of the Platform functions;

(b) allowing the use of the services reserved to registered Users in accordance with the Terms and Conditions of Access and Use of the Teascanner Platform and with the Terms and Conditions of the Sale Service on the Marketplace, which provides services at User's request such as the alert service, sending messages, reservation of goods and services, release of reviews and comments from Users etc.;

(c) carrying out any administrative and accounting activities related to registration on the Website and on the Marketplace Platform, making a purchase through the Marketplace Platform, complying and fulfilling legal obligations;

(d) sending advertising communication aimed to the promotion and/or sale of Products and/or Services similar to those already purchased/enjoyed by the User (so-called "soft spamming"), without prejudice to the User's right to object at any time;

(e) sending advertising communications about goods and services on sale on the Platform, promotions and news, coupons, carrying out marketing research by means of automated systems, e-mails, sms, mms, faxes, or similar, and/or by means of postal service (so-called marketing purposes);

(f) for the analysis of preferences and consumption habits and for processing User's personal preferences and interests by automated processing systems, to personalized offers which can be sent through the Platform or through the email address provided by the User, at the time of Registration and creation of the Personal Account (so-called "profiling" purposes);

(g) for the transfer and/or data communication to third parties operating in the following sectors: public administrations, professionals, other subjects operating in production and trade of Tea and related products (so-called "communication to third parties");

(h) for statistical and historical purposes (only anonymous data).

Personal data are processed with manual and electronic tools and are stored in the electronic database in charge. The personal data contained in the aforementioned automated information system, as well as those stored in the Data Controller's electronic archives are processed accordingly with the provisions of applicable and current Laws and the GDPR regarding safe and security measures, in order to minimize the risks of destruction, loss, modification, unauthorized disclosure or access, accidentally or unlawful, or treatment not in accordance with the purpose of the collection.
Furthermore, personal data are stored and kept for the time strictly necessary to achieve the aforementioned purposes, as well as to fulfill the legal obligations set up for the same purposes.

Nue s.r.l. processes the personal data freely entered by the User (Buyer and Seller) on the Website and/or on the Platform, such as, in particular, personal data, tax codes, contact details, telephone and/or fax numbers, e-mail addresses, data resulting from comments or reviews, etc., as well as autonomously generated technical data (in particular, IP addresses, log files relating to navigation on the Site, purchases made, etc.).
Nue s.r.l. will store, according with the applicable Laws, the log files and IP addresses used when making an online purchase, in order to prevent and ascertain any fraud in online transactions.

To make a payment on the Website and/or on the Platform via Paypal, the User must enter confidential data. These data will be acquired by the payment service provider who will act as an independent data controller, without passing through the Platform server. The data will be acquired in encrypted format and according to the security requirements of the PCI certification.

The provision of personal data for the purposes referred to points (a), (b) and (c) of art. 2 above is necessary to provide the relative services. In case of failure consent, User cannot complete goods and services purchase, sale, delivery and/or return procedures and cannot join the services reserved to registered Users or requested, from time to time, accordingly with the Terms and Conditions of use of the Marketplace Platform. As well, Nue s.r.l. will not be able perform any administrative and accounting activities. The consent to the processing of personal data for the aforementioned purposes is not required, in particular, pursuant to art. 6, par. 1, lett. b), of the GDPR and of the current legislation.

Regarding the purpose referred to point (d) of art. 2 above, consent to processing is not required under current legislation, however without prejudice to the User's right to object, at any time, to the send of advertising in the manner indicated below.

Regarding the processing purpose referred to points (e), (f), (g) the consent to the processing of personal data is purely optional, it being understood that failure to provide it will make it impossible: (1) for the User to receive advertising information and/or other commercial information relating to Nue s.r.l.'s or third parties' goods and/or services, including those belonging to the product sectors indicated above, to benefit from any promotional campaign; (2) for Nue s.r.l. to analyze the User's consumption habits in order to process and send specific offers based on the user's experience and preferences. The User is advised that in the event of receiving promotional advertise from third parties, they - not Nue s.r.l. - are required by law to release their own personal data requirements form, containing, in addition to those mentioned by art. 13 of the GDPR, also the specific source of personal data collected. In case the source would be Nue s.r.l., User can always object the processing personal data, pursuant to art. 21 of the GDPR. Third parties are required also to provide the User with a suitable address (eg: an email address) where he can exercise the rights under the GDPR usefully and quickly, economically and effectively.

Personal data collected from the User, for the purposes described in art. 2 above, may be shared and disclosed to the following recipients:

- employees and/or consultants of Nue s.r.l. for carrying out administration, accounting and IT and logistic support activities;

- public and/or private entities, natural and/or legal persons (legal, administrative and tax consultancy firms, shippers and couriers, any IT companies and any other subject, including third-party sellers operating on the Marketplace) which collaborate with Nue s.r.l., to carry out the activities referred to in points (a), (b) and / or (c) of art. 2;

- private subjects, natural or legal persons also operating outside the Italian territory (without prejudice of standard contractual clauses about transferring personal data to those designated for processing them, in accordance to European Commission decisions);

- to all those subjects (including Public Authorities) who have access to data by virtue of regulatory or administrative provisions.

All personal data provided by Users at the time of registration on the Website and/or on the Platform and/or of the purchase through the Website and/or through the Platform are not subject to disclosure.

Pursuant to art. 15 and ss. of the GDPR and other applicable Laws, the User has the right to lodge a complaint to the Italian Data Protection Authority and to revoke any consent given at any time, to:
